That was the court's whole point.<br /><br />The "Big Chief" case-- courts rarely throw out cases sua sponte (on their own) because the briefs are poorly written. There aren't really rules that say they could in part because that's very subjective. Then you'd double the courts' workload (or more) because people would be appealing the cases being tossed out, and they probably wouldn't write the appeals any better than the original pleadings.
